Coverage issues and coverage litigation which arise between policyholders and our insurance clients constitute a significant part of our practice. We have represented many of our insurance company clients on a regional as well as national basis by providing detailed coverage opinions or by prosecuting and/or defending declaratory judgment lawsuits. In the course of this work, our attorneys have developed significant expertise on a wide range of coverage issues in connection with CGL, professional, auto and property policies. Some of the more significant coverage issues addressed by our attorneys follow:
- Analyzed coverage available under CGL, Business Auto and Commercial Umbrella policies for claims arising out of fatal highway accident involving daylaborers being transported to insured's factory.
- Prepared opinion, under Florida law, regarding the insurer's duty to defend and indemnify insured owner of an exclusive condominium complex against claims by individual condominium owner that insured had misrepresented material facts, breached the contract of sale, discriminated against the owner and breached the implied warranty of habitability.
- Drafted opinion concerning availability of insurance coverage for claims brought against insured petroleum company as a consequence of breakup of oil-carrying barge off the coast of Puerto Rico, causing widespread pollution of tourist beaches.
- Prepared opinion, under the law of Alabama and West Virginia, regarding insurer's duty to defend and indemnify insured, whose predecessor-in-interest had manufactured furnace which exploded, killing or injuring several persons.
- Prepared opinion, under Alabama law, on duty of insurer client to defend and indemnify insured real estate agent against statutory claim by home buyer of "suppression" (misrepresentation) regarding termite infestation.
- Opined regarding whether "step-down" provision in garage policy issued to used-car dealer could validly restrict amount of coverage available to insured customer who was test-driving vehicle when he was involved in an accident.
- Prepared opinion, in warehouse fire case, regarding effect of insured's failure to comply with Pennsylvania's Act 98 on the insurer's obligation to pay on structural damage claims.
- Represented insurer in declaratory judgment action filed by plumbing supply house which was accused of permitting supervisor to sexually harass female employees.
- Represented insurer in California and Pennsylvania coverage litigation arising out of a national recall campaign of an insured's product.
- Represented several insurers in coverage litigation arising out of misappropriation of trade secrets, patent and trademark infringement and other advertising injury related coverage issues.
