Environmental and Toxic Tort Insurance Coverage/ Declaratory Judgment Actions

Our attorneys' experience in this specialized type of insurance coverage goes back to the "heyday"of environmental coverage litigation in the early 1980's. Our attorneys have worked on coverage cases where the issues involved underlying chemical plants, refineries, recycling facilities, landfills, junkyards, lagoons, floor drains, drum disposal and point-source discharges, to name just a few. We have litigated critical coverage issues such as "expected/ intended", "sudden & accidental", "known loss", "loss-in-progress", "owned property" and many others. Some of the cases in which this expertise was developed include:

  • Obtained favorable settlement on behalf of insurer client in Pennsylvania action involving underlying claims of fetal injury from alleged workplace exposure to toxic paint fumes.
  • Represented major insurance company in multimillion dollar coverage litigation brought by W.R. Grace concerning extensive soil and groundwater pollution at the so-called "Hatco" facility in Edison, New Jersey.
  • Represented major insurance company in coverage action by Hyde Athletic (Saucony) seeking defense and indemnity in connection with waste disposal activities at Dorney Road Landfill in Allentown, Pennsylvania.
  • Obtained favorable settlement in multi-site New Jersey declaratory judgment action filed by Johnson Matthey, Inc. involving acid lagoon wastes, drummed chemicals and liquid waste disposal.
  • Obtained directed verdict in favor of major insurance company client in $30 million dollar coverage case against CPC International arising out of perchlorethylene (PERC) contamination at Petersen Puritan facility in Rhode Island.
  • Negotiated favorable settlement of coverage action by major sprinkler manufacturer involving complex environmental claims.
  • Currently defending major insurance company client in coverage action where insured is being sued for alleged injuries from ingestion of lead paint in rental unit.
