While many of the Firm's major clients are insurance carriers, the Firm also has substantial experience in commercial litigation arising out of construction projects, quarry operations and building developments. Our attorneys have successfully handled multimillion dollar claims in cases as diverse as a construction project in a major petrochemical refinery in Puerto Rico and blasting operations at a limestone quarry in central Pennsylvania. Some of the firm's noteworthy accomplishments in this type of litigation include:
- Industrial Crane Accident. Aggressively represented a petrochemical refinery owner against a general contractor that caused a crane to collapse during the lift of a 106 ton convection section. The direct damages relating to the crane collapse were in excess of $5,000,000.00. We spearheaded the investigation and analyses of the crane, the lifting procedures, the engineering and lifting plans, weather conditions and the contractor's performance. Through our efforts, our client obtained a $19 million dollar settlement.
- Dryvit® Insulation. Effectively defended contractors in actions involving the installation and maintenance of exterior insulation finishing systems, commonly referred to as Dryvit® exteriors.
- Business Interruption Claims. Successfully represented the owner of an industrial facility which sustained approximately $48,000,000.00 in business interruption losses. Our attorneys retained and worked closely with forensic accountants who performed charge/yield, market and opportunity cost analyses as well as a calculation of lost profits.
- Stormwater Drainage Systems. Represented various clients in actions involving the design, construction and maintenance of complex stormwater management systems in both residential and commercial developments, including on-site recharge beds and drainage systems regulated by New Jersey's Coastal Area Facility Review Act ("CAFRA").
- Construction Property Damage. Aggressively defended developers, design professionals, project managers, general contractors and subcontractors, including electricians, plumbers, masons, carpenters, ironworkers, HVAC subs, insulation contractors and concrete subs in cases alleging property damage caused by defective workmanship and/or materials.
- Mining Operations. Represented and negotiated a favorable settlement for the owner/operator of a limestone quarry sued by an adjacent property owner for damage to its buildings allegedly caused by the quarry's blasting and mining operations and the resulting removal of lateral support.
- Exterior Facades. Defended a precast concrete contractor in a lawsuit involving the deterioration and spalling of a decorative brick exterior on a major corporation's headquarters building due to water infiltration. Our client had supplied and installed precast concrete sills and wall capping and eventually settled out of the case for a nominal sum.
- Architects. Successfully defended both a project architect and general contractor who were allegedly negligent in the specification, selection and placement of structural fill and in the failure to provide adequate geotechnical engineering.
